TERMS AND CONDITIONS
SUBJECT
These General Terms and Conditions regulate distance sales contracts, as defined by the Consumer Protection Act, between "Stoykovmed" Ltd. (Dr Stoykov) and consumers, regarding the ordering and purchase of goods offered through the online store – www.drstoykov.net.
COMPANY DETAILS
2. "Stoykovmed" Ltd. is a commercial company, as defined by the Commercial Law, with UIC: 208615035, VAT number: BG208615035 and registered office: "Han Krum" Str. No.13, floor 3, apt.9, 5800 Pleven, Bulgaria. Manager: Martin Stoykov.
3. "Dr Stoykov" is a registered trademark of "Stoykovmed" Ltd. and is its property. Dr Stoykov administers the website www.drstoykov.net and its subdomains.

GENERAL DEFINITIONS
5. For the purposes of these general terms and conditions, the terms below have the following meaning:
5.1. Seller – Dr Stoykov or any of the partners of "Stoykovmed" Ltd. published on the website.
5.2. Website/Site – the internet pages attached to the domains www.drstoykov.net and their respective subdomains.
5.3. Webpage – a constituent and distinct part of a website.
5.4. User/Client – Any person who is not an employee of Dr Stoykov and uses the aforementioned internet pages in any way.
5.5. "User profile/Account" – a distinct section on the website containing information about the User, provided by them during registration and stored by www.drstoykov.net, with access to the user profile being made through entering a username and password. The user profile allows the User to view and edit the data entered during registration, address book entries, access information about all their requests for purchasing goods from the e-commerce store www.drstoykov.net, change their access password, subscribe, or unsubscribe, from receiving a newsletter, etc.
5.6. Order – a request from the client, through which they express their intention to purchase goods or services from the website.
5.7. Store/Catalog – a list of goods located on the website and representing its main content, to which clients have free access.
5.8. Product – an item from the catalog located on the website, which is the subject of the sales contract.
5.9. Contract – any distance contract concluded between Dr Stoykov and a client for the purchase and sale of goods from the website, as a result of an Order placed by the client. These general terms and conditions are an integral part of this contract. Each separately placed order constitutes a separate contract.
5.10. Content – All information on the website that can be viewed using an electronic device; the content of any information sent by the client to the Seller and vice versa.
5.11. Newsletter, Brochure, Notification – informational means concerning products on the Dr Stoykov website, without being bound by the information provided.
5.12. Payment – collection or refund of funds resulting from a product sale.
5.13. Force Majeure Event is an unforeseeable event, beyond the control of the parties, which cannot be avoided.
GENERAL PROVISIONS
6. The General Terms and Conditions define the rules, compliance with which allows the Client to use the website and its content, in cases where no other valid agreement between them and the Seller exists.
7. The General Terms and Conditions are mandatory for all clients of the website. Its use signifies that the client has carefully read and agreed to them, with each use.
7.1. The data and personal information provided by users/clients are used by Dr Stoykov to manage orders, deliver products and services, process payments, communicate via Email, SMS, Viber, WhatsApp, Social media platforms (Facebook, Instagram, TikTok) with users/clients regarding orders, products, services, and promotional offers or product recommendations.
8. The General Terms and Conditions may be changed unilaterally and at any time by Dr Stoykov. These changes come into force immediately after their publication on the website.
9. By accepting these General Terms and Conditions, the Client gives their explicit consent to conclude distance contracts, as a result of an Order placed by them.
10. Dr Stoykov reserves the right to terminate or refuse a client's registration, unilaterally, at its discretion, without owing any penalties or compensation for this.
11. The possibility to order is valid only for the territory of the Republic of Bulgaria and only for persons aged 18 or over. By registering on the website and creating an order, the client declares that they are an adult (aged 18 or over).
12. Dr Stoykov clarifies that the images (static/dynamic presentations, etc.) of the products are for informational purposes and the delivered products may differ from those depicted due to technical errors, changes in characteristics, design, or revisions. The Seller is not responsible for such discrepancies.
13. The characteristics, descriptions, and prices of goods on the website may contain errors and be changed at any time. The Seller is not responsible for such discrepancies but is obliged to rectify them promptly if pointed out by a Client.
14. Dr Stoykov reserves the right to make changes to the website, its structure, and functions, without prior notification to clients.
15. Dr Stoykov is not responsible for any errors that may occur on the website due to technical reasons.
16. Dr Stoykov reserves the right to publish advertising banners of any kind and/or links, on any part of the website, in accordance with applicable law.
17. All goods, including those on promotion, are sold and delivered until stocks are exhausted in the Seller's warehouse, even if this is not explicitly noted on the website.
18. The website may contain links to other websites, and Dr Stoykov is not responsible for the content and policies of these websites.
19. The Seller and the client agree that electronic communication between them, including the use of a specific account, has the force of a handwritten signature in their relations.
20. If any of the provisions of these general terms and conditions for website use is invalid or inapplicable to a specific contract, regardless of the reason, this does not result in the invalidity or inapplicability of the remaining provisions.
SALES CONTRACT
21. The contract for distance selling of goods is considered concluded from the moment the Seller accepts the order sent by the Client.
22. The Seller notifies the client by email and/or phone about the registration of the order.
23. In all cases where the order is registered and the client has received confirmation thereof, the client owes full payment, which is agreed upon for each individual order.
24. The Seller reserves the right, in case of impossibility of delivery, to partially or fully withdraw from the contract, in which case it is obliged only and solely to refund the received amounts, without expenses for the client.
25. When the stock availability of a particular item proves insufficient to fulfill all received orders, the rule from the previous point applies.
26. The information provided by the client, as well as these general terms and conditions, are an integral part of the Distance Contract.
INTERNET SALES POLICY
27. Access to the website for account registration and order creation is permitted to every client. The client is responsible for the accuracy of the provided data and for complying with the special legal requirements related to concluding civil law contracts.
28. Dr Stoykov may restrict access to orders, goods, services, payment methods and others to any client, at its discretion without prior warning or notice. Dr Stoykov is not responsible for any damages that the client suffers or may suffer as a result of this decision.
29. Each client can only have one account on the website. One account is not allowed to be shared between several clients, and the client is responsible for all damages from such sharing.
30. All prices on the website are quoted in Euros (EUR) with VAT included.
31. The price of a product does not include the shipping cost and applicable payment fees. In all cases, before completing the order, Dr Stoykov will indicate on the website the amount of additional costs that the client must pay.
32. It is possible that after purchasing a product, Dr Stoykov may request a review from the client regarding the purchased product via email, phone, or other communication methods. By voluntarily providing a Review and/or photo, the client gives their explicit consent for Dr Stoykov to use this Review and/or photo for promotional purposes on its website or its subdomains.
33. Prices on the website, struck through with a line, indicate the old price of the item in the store. These prices are for informational purposes and do not relate to the actual price owed.
34. When presenting goods and services, Dr Stoykov reserves the right to use other products (accessories and others) that may not be included in the product's price. In such cases, the product description specifies the products included in the set, and any product not included in the same description is considered not to be included in the set.
35. Dr Stoykov reserves the right to change the prices of goods and services at any time, without prior notification to clients.
36. The price of products and services is that indicated at the time of order within the limits of stock availability and/or for the period of the promotional period, if any. Any changes in prices occurring after the order acceptance do not apply to it.
37. Dr Stoykov does not guarantee the availability of any product that can be purchased from the website until it confirms the same to the client by email or phone that the order has been fulfilled and handed over for delivery.
38. Dr Stoykov may, at its discretion, issue discount promotion codes to individual users/clients. The value, scope, and validity period are determined unilaterally by Dr Stoykov. Provided promotion codes MAY NOT be shared with other users/clients.
38.1. Two (2) or more promotions cannot be applied to one order.
ORDER
39. The client can place an order on the website by adding the offered goods and services to the shopping cart, following the instructions and steps on the website to complete and submit the order.
40. By completing their order, the Client agrees that all information provided, necessary in the purchasing process, is accurate and complete at the time of placing the order.
41. Unfinished orders do not lead to order registration.
42. Goods and services are available within stock limits and can be confirmed or rejected depending on availability.
43. Dr Stoykov reserves the right for availability and delivery times to be further specified by phone or email, at the time of order processing.
44. Dr Stoykov is not responsible for meeting product delivery deadlines.
45. Until delivery, the Seller may refuse to fulfill partially and/or entirely a placed order when delivery proves impossible due to objective reasons, or due to legal defects in the concluded contract, by prior notification to the client. In such cases, the Seller is obliged to refund any sums paid by the client, without incurring any additional costs for the client, after which the contract is considered terminated and the parties to it have no other obligations to each other.
46. By submitting the order, the client grants the Seller the right to contact them in any possible way when this is necessary in connection with the placed order.
47. In the event of a change in delivery times or in the content of a placed order or other contract terms, a Dr Stoykov employee will contact the client by phone or email to inform them. In such a case, the client has the right to withdraw from the contract or confirm the order. In both cases, the Seller is not responsible for damages beyond the responsibility for refunding the paid amounts.
48. A client can cancel a placed order until receiving information that the order has been prepared for shipment. This can be done via email at: martinstoykovmd@drstoykov.org. In these cases, the Seller fully refunds any sums paid by the client, in the same manner in which payment was made, without any costs to the client. The client is not responsible for damages and lost profits, and the contract is considered annulled.
RETURN OF GOODS AND WITHDRAWAL FROM A DISTANCE CONTRACT
49. According to the distance sales contract, any client who qualifies as a consumer can return a product in undamaged commercial condition without specifying an objective reason for complaint within 14 calendar days from the date of receipt of the goods. Transport costs for returning the goods are the obligation and responsibility of the client. Dr Stoykov will not accept goods sent with cash on delivery.
50. Other grounds for termination of the distance contract by the client are:
50.1. Damaged packaging – The Client may request a replacement of the goods if they find them to be in poor commercial condition. In this case, the costs of returning the product are borne by the Seller. Upon acceptance of the goods by the Client, and if within 24 hours the Client does not send written or telephone information to Dr Stoykov regarding any established damage to the respective products, then they are considered to have been received in good commercial condition. In such a case, Dr Stoykov is not obliged to replace the respective products.
50.2. Incorrect goods upon delivery. If the client determines that the goods delivered by the courier are different from what they ordered, they may return them to the courier to have the correct ones sent. Delivery costs are borne by the Seller.
51. The client is obliged to inform the Seller of their intention to return the purchased goods or to withdraw from the distance contract by clearly stating their decision through written communication by email within the specified period. To exercise their right of withdrawal, the client must use a withdrawal form. If the 14-day period for returning a product is not met or the product is returned without the Client having notified the Seller, the latter is not obliged to refund the sums paid by the Client.
52. In case of a problem with the purchased goods, the client can contact the Seller at email address: martinstoykovmd@drstoykov.org. The standard response time is between 24 and 48 hours, excluding weekends and official holidays.
53. The goods should be returned to the warehouse of "Stoykovmed" Ltd.: 13 Radecki Street, Troyan, for Dr Stoykov with an option for inspection, so that their condition and compliance with the return conditions can be checked.
54. In the event that the client exercises their right of withdrawal, Dr Stoykov is obliged to refund the full amount paid no later than 14 calendar days from the date on which the goods were returned to Dr Stoykov's warehouse. The costs for returning the goods shall be deducted from the amount paid by the consumer under the contract, unless the client has returned the goods at their own expense and has notified the supplier of this.
54.1. If, after sending the order, the client decides they do not wish to receive it, they must send it to "Stoykovmed" Ltd. at their own expense. In such a case, the client is obliged to provide "Stoykovmed" Ltd. with a valid tracking number for the sent order. "Stoykovmed" Ltd. is obliged to refund the amount paid by the client within 14 days after confirming that the shipment has been received back at the warehouse and the condition of the products has not been compromised.
55. The Seller has the right to delay the refund until the sold goods are received and is not responsible for shipments that have not been delivered to its warehouse.
56. The refund is made by bank transfer to the account specified in the withdrawal form.
57. If the client exercises their right of withdrawal from the distance contract, they must return the goods to Dr Stoykov without undue delay and no later than 14 days from the date on which the consumer informed of their decision to withdraw from the contract. The deadline is considered met if the consumer sends information about their decision to Dr Stoykov in writing before the expiry of the 14-day period.
58. The replacement period due to a received broken vial is 15 calendar days, counting from the day the client accepted the goods. The client is obliged to provide photographic material or video for the reported defect. After this period, Dr Stoykov has the right to refuse return or replacement of these products.
59. If the right to withdraw from the distance contract is exercised, the customer undertakes to store the goods received from the supplier, their quality and safety until their return.
60. In the event that an ordered and pre-paid item cannot be delivered by the Seller, the latter will inform the customer of this and will refund the paid amount within 14 days from the date on which the Seller became aware of this fact or from the date on which the customer expressed their desire to cancel the contract.
61. Conditions for return or exchange:
61.1. The customer must notify the Seller in writing by email with a completed return form. In case of a problem related to the products, the customer must provide photographic or video material.
61.2. All goods must be in the same condition as upon delivery, undamaged, in good commercial condition and complete. The packaging must be intact, not torn, scratched or damaged;
61.3. If the item was accompanied by a gift, the gift must also be returned;
61.4. According to the Distance Sales Agreement, every customer has the right to return purchased products in an undamaged commercial condition, without providing an objective reason for doing so, within 14 days after the date of purchase. In such a case, the costs of returning the order to "Stoykovmed" Ltd. are borne by the customer. "Stoykovmed" Ltd. will not accept delivery of returned products sent with cash on delivery.
61.5. If the customer wishes to return a product that was purchased as part of a promotional package, the regular price of the remaining products (or the price of a promotional package, if there is one with the same products) will be accepted as the new price of the order. The difference between the amount paid by the customer and the new price of the order will be refunded to the customer within 14 days after the customer returns the product to "Stoykovmed" Ltd.
62. If the goods are returned in an opened/used condition in which they cannot be sold as new, the Seller reserves the right to refuse the refund of the amounts paid by the Customer for the order, as well as subsequent costs for returning the product.
PAYMENT
63. The prices of goods and services are final and include VAT, as well as all other taxes and fees provided for by current legislation.
64. The price and method of payment are specified in each order.
65. Payment methods offered by Dr Stoykov are: cash on delivery upon delivery and payment by credit/debit card directly on the website.
66. The customer agrees to make payment according to the method chosen by them and according to what was agreed upon concluding the distance contract.
67. The customer agrees that the Seller has the right to request and accept advance payment for contracts for the sale of goods and their delivery concluded with the customer.
68. In the event that Dr Stoykov does not receive payment according to the method chosen by the customer and within the agreed deadlines before order fulfillment, it is considered rejected by the customer.
DELIVERY
69. The Seller delivers ordered online goods via Econt or Speedy courier company - to an address specified by the customer or to an office of the courier company specified by the customer.
69.1. "Stoykovmed" Ltd. is not responsible if an order has a "delivered" status with the courier company, and the customer has claims regarding it. In such a case, the customer must fill out an application and submit it to "Stoykovmed" Ltd., so that the latter can initiate an investigation with the courier company.
70. The Seller delivers goods only on the territory of the Republic of Bulgaria.
71. The sold goods are accompanied by the necessary documents and original packaging.
72. Delivery time is between 1 and 3 working days. An exception is point 47.
73. The delivery fee is €3.50 with VAT and €5.00 with VAT.
74. Delivery of orders containing goods worth over €44.99 (with VAT) is free for the customer.
75. Details regarding delivery times for goods are indicative and the Seller is not bound by them. The customer is not entitled to compensation in case of delayed delivery.
76. Deliveries are made from Monday to Friday between 09:00 and 18:00.
77. If the customer is not found at the address, the shipment is returned to the courier's office for pickup. If the customer does not contact the Seller the next day, the order is considered canceled.
78. The customer has the option to examine the contents of the shipment before paying.
79. Dr Stoykov or a representative of the courier company will notify the customer by phone or email if unforeseen circumstances arise.
81. The customer must inspect the goods at the time of delivery and notify the Seller immediately of any discrepancies.
82. The risk of loss or damage passes to the customer at the moment they or a third party designated by them accepts the goods from the service company chosen by Dr Stoykov.
TRANSFER OF OWNERSHIP
83. Ownership of the goods is transferred upon their delivery to the customer, after payment has been made.
SUBCONTRACTORS
84. The Seller has the right to use subcontractors without notifying the customer. The Seller is responsible for their actions.
INTELLECTUAL PROPERTY
85. All content (images, design, software, etc.) of the website is owned by Dr Stoykov or by third parties with permission to use.
86. All content is protected by law, unless there is a written agreement between Dr Stoykov and the customer.
87. The contract does not grant the customer permission to copy or modify the content of the website without the explicit consent of Dr Stoykov.
CONFIDENTIALITY
88. The customer agrees that personal data may be used for lawful purposes without additional consent in each case.
89. Dr Stoykov may, without the customer's consent, collect data such as IP address, operating system, and browser version.
90. The customer may request deletion of their information, thereby withdrawing their consent from the General Terms and Conditions.
91. By providing data, the customer agrees to be contacted by the Seller or partners of Dr Stoykov.
92. The customer is responsible for the security of their password and account.
PERSONAL DATA
93. Dr Stoykov collects and stores personal data in compliance with Regulation (EU) 2016/679 and the Personal Data Protection Act. Detailed information can be found in Dr Stoykov's Privacy Policy, which is an integral part of these terms.
94. The user has the right to access and correct their personal data.
95. Data may be provided to state authorities only upon explicit request in accordance with the law.
LIABILITY
96. The Seller is not liable for damages due to force majeure.
97. The Seller is not responsible for physical/mental injuries or allergic reactions. Consult a doctor for chronic illnesses. Dr Stoykov's products are not recommended for pregnant women, nursing mothers, and minors; they are not a medicine. It is mandatory to follow the instructions on the label.
98. Dr Stoykov is not responsible for the actions of individuals using the content of the website.
99. Dr Stoykov is not responsible for direct or indirect damages resulting from the inability to use the website.
100. Dr Stoykov does not guarantee the availability of products until final confirmation of the order.
101. Dr Stoykov does not guarantee that the goods will meet the individual expectations of the customer.
102. Dr Stoykov is not liable for lost profits or loss of information.
103. In all other cases, liability is limited to the value of the ordered goods.
ADVERTISING
104. By creating an account, the customer agrees to receive brochures and newsletters from Dr Stoykov.
105. The customer can unsubscribe at any time via a link in the email, through their account, or by emailing the Seller.
106. By accepting the terms, the customer agrees to receive calls and messages for the purposes of the contract.
108. Dr Stoykov reserves the right to remove contacts from its database without prior notice.
109. Dr Stoykov does not distribute spam within the meaning of the Electronic Commerce Act.
FORCE MAJEURE
111. The parties are not liable for non-performance due to force majeure.
112. If the circumstance lasts more than 14 days, either party may terminate the contract without compensation.
DISPUTES AND APPLICABLE LAW
113. The document is interpreted in accordance with Bulgarian law.
114. Use of the website implies acceptance of these General Terms and Conditions.
115. Disputes between a client and Dr Stoykov are resolved through negotiations. If this is not possible, disputes with companies are referred to the Sofia Arbitration Court, and with individuals – to the competent Bulgarian court.
116. Supervisory authorities: Commission for Consumer Protection (www.kzp.bg) and the European Commission (online dispute resolution).
